An easy-to-use maintenance booklet to comply with new laws

The maintenance log is intended to be a register tracing the maintenance history of the co-ownership as well as all operations carried out and to come. It is used in condominiums to track and document maintenance activities.

Article 1070 of the Civil Code of Quebec was amended in December 2019 by Bill 16 and in February 2024 by Bill 31. It now includes a second paragraph (article 1070.2) stipulating that “The board of directors has a building maintenance log drawn up, which describes in particular the maintenance carried out and to be carried out.  The board maintains this booklet up to date and has it revised periodically”.  These bills impose specific legal requirements regarding maintenance logs for co-ownerships in Quebec.

The requirements are summarized as follows:

  • Establishing and updating the maintenance logbook ensuring that all relevant maintenance activities are accurately recorded and documented;

  • Identification of the responsibilities of the Union and the co-owners with regard to maintenance tasks;

  • Ensure compliance by ensuring that maintenance activities are carried out in accordance with legal requirements and established by the Syndicate of Co-owners;

  • Communication with the co-owners of the content of the maintenance log in order to ensure transparency and accountability in the management of maintenance activities within the co-ownership.

In summary, the maintenance log is an essential tool for monitoring and documenting maintenance activities in the co-ownership. The Syndicate plays a key role in establishing, maintaining and respecting the maintenance log, which promotes transparency and responsibility in the management of the co-ownership.
